These Terms of Use (“Terms”) are entered into by and between you (“User”, “you”, or “your”) and LettrTube Inc. (“LettrTube”, “Company”, “we”, “us”, or “our”).

By accessing or using https://www.lettrtube.com and all related products, tools, features, and services (collectively, the “Platform” or “Services”), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must not use the Platform.

1. Eligibility

You must be at least 16 years old to use LettrTube.

By using the Platform, you represent that:

• You have legal capacity to enter into a binding agreement;
• You comply with all applicable laws;
• You are not prohibited from using the Services under any applicable jurisdiction.

2. Account Registration and Security

You are responsible for:

• Providing accurate and current account information;
• Maintaining confidentiality of login credentials;
• All activity under your account.

You must notify us immediately of any unauthorized access.

LettrTube may suspend or terminate accounts at its sole discretion, including for violations of these Terms.

3. Platform License

LettrTube grants you a limited, non-exclusive, non-transferable, revocable license to use the Platform in accordance with these Terms.

You may not:

• Reverse engineer or copy the software;
• Resell or sublicense access;
• Scrape, extract, or harvest data;
• Circumvent security or monetization systems.

4. User Content

You retain ownership of content you publish.

By submitting content, you grant LettrTube a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote that content for operation of the Platform.

You are solely responsible for your content.

5. Content Standards

You agree not to publish content that:

• Violates laws;
• Infringes intellectual property;
• Contains hate speech or incites violence;
• Promotes illegal or harmful activity;
• Is fraudulent or deceptive;
• Violates privacy rights;
• Contains explicit unlawful adult content;
• Impersonates others.

LettrTube reserves the right to remove or restrict content at its discretion.

6. Promotions Marketplace

LettrTube may provide promotional marketplace features for eligible users.

Deposits and Fees

• Deposits are non-refundable unless required by law.
• LettrTube may retain up to 15% platform fee plus up to 5% processing/infrastructure fees.

Withdrawals

• Minimum withdrawal threshold: $50 USD.
• Payouts processed through third-party payment providers.

No Guarantee

LettrTube does not guarantee subscriber growth, revenue, engagement, or performance.

Abuse and Circumvention

Attempts to manipulate or bypass the system may result in:

• Account suspension;
• Forfeiture of funds;
• Permanent termination.

7. Monitoring and Enforcement

LettrTube may:

• Remove or restrict content;
• Suspend or terminate accounts;
• Withhold unpaid earnings in case of violations;
• Cooperate with law enforcement;
• Disclose information where legally required.

We are not obligated to pre-screen content.

8. Copyright Policy (DMCA)

If you believe your copyright has been infringed, submit a notice to:

Repeat infringers may have accounts terminated.

9. Payments and Refunds

Unless otherwise required by law:

• All sales are final and non-refundable.
• You are responsible for taxes and payment compliance in your jurisdiction.

10. Third-Party Links

The Platform may contain links to third-party websites.

We are not responsible for:

• External content;
• Third-party services;
• Damages arising from their use.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

To the fullest extent permitted by law, LettrTube disclaims all warranties, including:

• Merchantability;
• Fitness for a particular purpose;
• Non-infringement;
• Security;
• Availability;
• Error-free operation.

We do not guarantee uninterrupted access.

12. Limitation of Liability

To the fullest extent permitted by law, LettrTube shall not be liable for:

• Indirect or consequential damages;
• Loss of revenue or profits;
• Business interruption;
• Loss of data;
• Emotional distress;
• Security breaches beyond our reasonable control.

Total liability shall not exceed the amount paid by you to LettrTube in the 12 months preceding the claim.

This does not apply to gross negligence or willful misconduct where prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless LettrTube, its affiliates, employees, and contractors from claims arising out of:

• Your content;
• Your violation of these Terms;
• Your misuse of the Platform;
• Your infringement of third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

Disputes shall be resolved exclusively in courts located in New York County, New York.

You waive objections to jurisdiction and venue.

15. Time Limitation

Any claim must be brought within one (1) year of the event giving rise to it.

16. Waiver and Severability

Failure to enforce any provision does not constitute waiver.

If any provision is deemed invalid, remaining provisions remain in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and LettrTube.
